Terms of Service

These Terms of Service ("Terms") govern your use of Ashfall Kingdoms ("the Game", "we", "us") — in a web browser at play.ashfallkingdoms.com or through our mobile apps — and of this website. By playing the Game or using the site, you agree to these Terms. If you do not agree, please do not use the Game. Our Privacy Policy explains how we handle your data and is part of these Terms.
1. Who may play
You must be at least 13 years old (or the minimum age required in your jurisdiction) to play the Game and at least 18 — or have a parent or guardian's permission — to make purchases. If you accept these Terms on behalf of a minor in your care, you are responsible for their use of the Game.
2. Your account
- The Game is fully playable as a guest with no account. Signing in (for example with Google) is optional and adds cloud save and cross-device sync.
- You are responsible for activity on your account and for keeping access to your sign-in method secure. Tell us promptly at [email protected] if you believe your account has been compromised.
- One account per person. Accounts may not be sold, traded, or transferred.
- You can delete your account and its server data at any time as described in the Privacy Policy.
3. Virtual items and currency
- The Game contains virtual currencies (such as gold and Crowns) and virtual items (such as heroes, item packs, chests, cosmetics, and the season pass). These exist only inside the Game.
- Whether earned in play or bought, virtual items and currency are a limited, revocable, non-transferable license to use those features in the Game. They are not your property, have no real-world monetary value, cannot be exchanged for money or anything of value outside the Game, and may not be sold or traded outside the Game.
- We may adjust, rebalance, add, or retire virtual items and currencies as part of operating and improving the Game.
4. Purchases and refunds
- Where you buy matters: purchases in the mobile apps are processed by the platform store (Google Play or the Apple App Store) under that store's terms and refund policy; purchases in the web version are processed by Stripe. We never see your card details.
- All purchases of virtual content are final once delivered, except where the platform's refund policy or the law of your country says otherwise (for example, statutory withdrawal rights in the EU/UK — note that by purchasing digital content for immediate delivery you consent to immediate performance and acknowledge that the withdrawal right is lost on delivery, where that rule applies).
- For store purchases, refund requests go to the store (Google/Apple). For web purchases, contact [email protected] and we will review in good faith; accidental or unauthorized purchases reported promptly will be treated generously.
- Subscriptions (such as the Warlord's Pact) renew until cancelled through the provider you subscribed with; cancelling stops future billing and your benefits simply run out at the end of the paid period.
- Prices may change; changes never affect what you have already bought.
5. Player conduct
Some things you name or create — your company name, alliance name, and similar — are visible to other players on ladders and in alliances. When using the Game you agree not to:
- use names or text that are hateful, harassing, obscene, illegal, or that impersonate another person, company, or Ashfall Kingdoms staff;
- cheat — including exploiting bugs for advantage, tampering with the client, save data, or network traffic to gain an unfair edge, botting, or manipulating matchmaking, ladders, or rewards;
- attack or disrupt the service (probing, scraping at abusive volume, denial of service, unauthorized access attempts);
- buy, sell, or advertise accounts, virtual items, or currency for real money outside the Game.
We may rename or remove offending names and content, reset ill-gotten rankings or rewards, and suspend or terminate accounts that break these rules — with warning where reasonable, immediately for serious violations. Found a bug or a security hole? Please report it to [email protected] instead of exploiting it — we're grateful, and we say so.
6. Ownership
- The Game — its code, art, music, writing, characters, world, and names — belongs to us and our licensors and is protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable license to play it for your own entertainment. That license is what these Terms can suspend or end; it is not a sale.
- You keep whatever rights you have in names and text you enter, and you grant us a worldwide, royalty-free license to display and use them inside the Game and in connection with operating and promoting it (for example, showing your company name on the public ladder).
- Streaming, videos, screenshots, and reviews of the Game are welcome — including monetized ones.
7. Service changes and availability
Ashfall Kingdoms is a live, evolving game operated by a very small team. We may update, change, or discontinue features — or, if it ever comes to it, the Game or its online services as a whole — at any time. We will give reasonable notice of a full shutdown where practicable. We do not guarantee uninterrupted availability, and online features may be down for maintenance or beyond-our-control outages. Progress, including cloud saves, may occasionally be lost despite backups; we are not able to reconstruct lost progress in every case.
8. Termination
You may stop playing, or delete your account, at any time. We may suspend or terminate your access if you materially breach these Terms (see Player conduct), if required by law, or if the Game is discontinued. Where an account is terminated for breach, no refund is owed for unused virtual items or currency, except where the law requires otherwise.
9. Disclaimers
The Game and the site are provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement — to the fullest extent the law allows. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the Game. Our total liability for all claims relating to the Game is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose and (b) USD $50. Nothing in these Terms limits liability that cannot be limited by law, including for our own gross negligence or willful misconduct.
11. Governing law and disputes
These Terms are governed by the laws of the jurisdiction where we are established, without regard to conflict-of-law rules, and disputes belong to the courts there — except that if you are a consumer, you keep any protection and forum rights granted by the mandatory law of the country where you live. Before going to court, please just email us — almost everything can be fixed at [email protected].
12. Changes to these Terms
We may revise these Terms as the Game evolves. We will post changes on this page and update the date above; material changes will also be announced in the Game. Continuing to play after a change takes effect means you accept the revised Terms. If you don't, stop playing and — if you wish — delete your account.

Summary, in plain words: be decent to other players, don't cheat, and don't resell what's in the Game. Coins and heroes you buy are game content, not investments. Purchases are refunded by the store you bought through. The Game will keep changing — that's the point of a live game — and if we ever have to close it down, we'll say so properly. When in doubt, email us; we're small enough to actually answer.
